This Withdrawal from Contract information is available in both German and English. The English version is provided for convenience only. In the event of any conflict or inconsistency, the German version shall prevail.
A. Right of Withdrawal
Introduction
Consumers have a statutory right of withdrawal in accordance with the following provisions. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or independent professional activity.
Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you, or a third party designated by you other than the carrier, takes possession of the last item of goods.
To exercise your right of withdrawal, you must inform us (Denkwise Ventures GmbH, Vormwalder Str. 2, 63825 Schöllkrippen, Germany, Tel.: +49 6024 6420710, E-mail: info@zummane.com) of your decision to withdraw from this contract by means of a clear statement (for example, a letter sent by post or an e-mail). You may use the attached model withdrawal form, although this is not mandatory.
You may also exercise your right of withdrawal online via our website at https://www.zummane.com/de/apps/widerruf. If you use this online function, we will promptly provide you with confirmation of receipt on a durable medium (for example, by e-mail), including the content of your withdrawal declaration as well as the date and time it was received.
To meet the withdrawal deadline, it is sufficient that you send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.
Effects of Withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of any additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and in any event no later than fourteen days from the day on which we receive notification of your withdrawal from this contract. We will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you. In any event, you will not incur any fees as a result of this reimbursement. We may withhold reimbursement until we have received the goods back or until you have provided evidence that you have returned the goods, whichever occurs first.
You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days has expired.
You shall bear the direct cost of returning the goods. For goods which, due to their nature, cannot normally be returned by post (freight-forwarded goods), the direct cost of return is estimated to be a maximum of approximately EUR 250 per item.
You are only liable for any diminished value of the goods if such loss in value results from handling the goods beyond what is necessary to establish their nature, characteristics, and functioning.
Exclusion or Early Expiry of the Right of Withdrawal
The right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and are manufactured according to the consumer’s individual specifications or choices, or that are clearly tailored to the consumer’s personal needs. This includes, for example, customised and made to order products.
